Brooklyn Personal Injury Lawyer
Brooklyn is the most populous of the five boroughs. Manhattan swells with commuters during working hours, but more people make their homes here in Brooklyn than anywhere else in New York City. While most of us go about our daily lives without incident, there is always the possibility of getting hurt in a car accident, a slip and fall on a broken sidewalk, icy stairs, or slippery floor, or suffering an injury due to medical malpractice, a defective product, or a construction accident.
We don’t like to think of these possibilities, but when they happen, they can become all-consuming. Injury victims are forced to undergo expensive medical treatment, suffer pain, miss work, and miss out on life while dealing with the consequences of their injury. If the accident was somebody else’s fault – another driver, a property owner or developer, a doctor or hospital, a product manufacturer, or even the Brooklyn city government – that negligent party and their insurance company are liable to you for the costs of your injury. Getting compensation for your injury requires the help of a skilled and dedicated legal team. That’s what we do at Michael Gunzburg, P.C.

What if the Insurance Company Says the Accident Was My Fault?
In a serious injury case where the costs are significant, you can expect the insurance company to try to limit their liability by pushing the blame for the accident on you instead of their insured. Even when it is clear their insured was at fault in causing the accident, the insurance carrier can still reduce its liability by saying you were negligent as well. New York’s “comparative fault” law means that when both parties share blame for the accident, the injury victim can only recover compensation in proportion to the other party’s fault. For instance, if your damages in a Brooklyn car accident add up to $100,000 but you are considered 30% at fault, then you could only recover 70%, or $70,000, of your damages from the other party.
Here are just some of the ways you could be considered partially at fault in a Brooklyn personal injury claim:
Another driver ran a stop sign and hit you, but you were speeding at the time or could have avoided the crash had you not been distracted
You were not watching where you were walking when you slipped on a liquid spill in a department store that the premises owner failed to clean up
You were injured by a dangerously defective product, but you were misusing the product at the time
You didn’t follow the pre-op or post-op instructions given to you by the hospital, which made the injuries you suffered from a surgical error worse than they would have been otherwise.
The most important thing to remember about comparative fault is that the insurance company is using this concept to pay you as little as they can. You can expect them to say you were at least partially at fault, but you don’t have to take their word for it. The negligent party and their insurer don’t have the final word on who was to blame for what. At Michael Gunzburg, P.C., we assemble a team of accident investigators, doctors, nurses and others to find out the facts behind the accident and your injury. We build a strong case that proves the other party’s negligence, and if you are not to blame, we’ll have the evidence to prove it. We push back against the insurance company’s bogus claims and make sure you are treated fairly. If we have to go to trial and prove to the jury who was to blame, we have the skills, experience and dedication to do it and a record of success in court that proves we can.
