Family Settles Medical Malpractice Lawsuit for $32.5 million after Doctors Cause Baby Son Brain Damage during Birth

A family who has suffered through their baby son’s severe brain damage at the hands of his doctors agreed to resolve their medical malpractice lawsuit against the negligent healthcare providers that delivered him this week. According to news reports covering the story, the medical malpractice lawsuit was filed by Miranda Garcia, the baby boy’s mother, in 2022 after the boy was injured by the doctors and medical professionals at the West Reading, Pennsylvania, hospital that delivered him. The baby boy, who was born in 2018 and who has not been named due to privacy concerns, now suffers from hypoxic ischemic encephalopathy, a condition that developed as a result of not enough oxygen and blood flow to the baby boy’s brain when he was delivered. According to Garcia and her legal team, the injury occurred because Reading Hospital doctors failed to identify that the baby was in fetal distress, which would have led them to take additional measures and to perform a Cesarean section. In addition, Garcia alleges that once her baby son was born with hypoxic ischemic encephalopathy, doctors and staff at the hospital failed to adequately treat the boy, which could have limited the amount of brain damage that he ultimately suffered.

Although the case was filed in 2022 and opening arguments took place in court this week, Garcia agreed to settle the case for $32.5 million. Garcia’s legal team says of the result, “[Garcia’s son] requires around-the-clock care, which his mother has largely shouldered. This settlement will help significantly to provide the care he needs and will help his mother navigate what will be an enormously difficult road ahead.”
