Family of New York Man Awarded $23.3 Million in Damages in Medical Malpractice Lawsuit

The family members of a New York man who died in December, 2018 were awarded $23.3 million in damages by a jury in their medical malpractice lawsuit against the hospital that negligently treated him. According to local news reports, Jesus Eduardo Espitia of Ossining, New York, died as a result of his doctors’ and nurses’ failure to “monitor for and prevent a blood clot” that advanced to a pulmonary embolism. The tragic case all began in 2018, when the 48-year-old accountant and elite bicycle rider was seriously injured by a hit-and-run driver while he was cycling. Mr. Espitia was treated for the traumatic brain injury caused by the accident by doctors and nurses at Westchester Medical Center in Westchester County, New York. After approximately one month after being admitted to Westchester Medical Center, Mr. Espitia reportedly was showing signs of his condition improving, and his medical team discharged him to a rehabilitation facility for further treatment and care. However, prior to being discharged to rehab, Mr. Espitia suffered a pulmonary embolism from a blood clot in his leg, and he died from cardiac arrest.

According to experts in the medical malpractice case that certain close family members of Mr. Espitia filed in 2019 after his death, Mr. Espitia’s medical team failed to “properly monitor for signs and symptoms of deep vein thrombosis and apply sequential compression devices, which are used to prevent blood clots.” In addition, experts believed that the nursing staff that treated Mr. Espitia had not been trained properly in preventing deep vein thrombosis, and had failed to adequately document his case. The jury ultimately awarded Mr. Espitia’s family members with $23.3 million in damages in the medical malpractice case earlier this month. Of Mr. Espitia’s terrible and avoidable death, and the resulting jury award in the medical malpractice case brought by his family members, his lawyers stated, “After a nearly six year [sic] battle, we’re happy that a jury has held the (Westchester) Medical Center responsible for Mr. Espitia’s untimely death.”
