New York City Failure to Diagnose Prostate Cancer Lawyer

Prostate cancer, the second most common cancer diagnosed in men, stems from malignant cancerous cells or a tumor that most often begins in the outer areas of the prostate gland. Your Prostate Cancer Lawyer or Prostate Cancer Attorney can help you understand this area of the law. The prostate is one of the male sex glands, located just below the bladder and in front of the rectum. It surrounds part of the urethra, the tube that carries urine from the bladder to the outside of the body.

The prostate makes the fluid that contains sperm, which becomes part of semen. The incidence of prostate cancer has been increasing in the U.S., partly due to such factors as increased screening and longevity. Those who are most at risk include men over the age of 55 and those with a family history of prostate cancer, as well as African Americans. Your Prostate Cancer Law Firm can determine if you were improperly diagnosed or there was a delay of your diagnosis causing the cancer to spread. Other risk factors include:

  • Benign prostatic hyperplasia (BPH), or an enlarged prostate
  • Exposure to sexually transmitted viral agents
  • Exposure to heavy metal and chemicals
  • A diet high in saturated fat
  • Sedentary lifestyle
  • Insufficient amounts of vitamin D

The earliest stages of prostate cancer often do not produce any symptoms. However, some symptoms that have been associated with prostate cancer include:

  • Frequent urination, especially at night
  • Exertion when urinating
  • Weak urine flow
  • Difficulty in starting urination or holding back urine
  • Inability to urinate
  • Painful or burning urination
  • Painful ejaculation
  • Blood in the urine or semen
  • Pain in the lower back, upper thighs or hips

Many of these symptoms are also associated with other conditions that are not cancerous, including prostatitis, prostate stones, infection and BPH, which is why patients should always seek a professional medical opinion regarding their symptoms. To diagnose prostate cancer, a physician will conduct a complete physical examination including a digital rectal exam, to search for any abnormalities that may indicate cancer or a pre-cancerous condition. The doctor may also order a prostate-specific antigen test, known as a PSA, and follow up on a positive digital rectal exam or elevated PSA level with a transrectal ultrasonography to confirm a possible cancer diagnosis and assist doctors in mapping the areas for a follow-up biopsy. The biopsy will assist in the determination of the patient’s Gleason score, an indicator of how likely the tumor is to spread.

Your Prostate Cancer Attorney or Prostate Cancer Lawyer can review your medical records to ensure that this test was performed. Once prostate cancer has been diagnosed, there are a number of tests used to stage the cancer and detect how far it has spread, including computerized tomography, lymph node biopsies and bone scans. The patient’s prognosis for survival is a function of the stage of the cancer, how far it has spread, his age and general health, as well as whether this is a first or recurrent diagnosis. Your Prostate Cancer Law Firm can review your medical records to determine whether there were any medical departures. If your physician has failed to diagnose your illness in a timely manner you should contact a prostate cancer law firm as soon as possible. A prostate cancer attorney will be able to guide, counsel and advise you with regard to whether you have a viable claim.

Depending on the patient’s age, the stage of cancer and the physician’s advice for the best course of treatment, a patient may undergo any of the following treatment options:

  • Watchful waiting involves close physician monitoring, usually of older male patients, with no treatment for slow-growing, early stage tumors
  • Radiation therapy
  • Surgery, including perineal prostatectomy, retropubic prostatectomy and transurethral resection of the prostate
  • Hormonal therapy, which may include removal of one or both testes, and/or giving men estrogen to stop the testicles from producing testosterone, slowing the growth of prostate cells

Some of the newer treatment options available include:

  • Cryosurgery, using an instrument to freeze and destroy cancer cells
  • Biologic treatment, using the patient’s own immune system to fight the prostate cancer
  • High-intensity focused ultrasound (waves) to destroy cancerous cells
  • Chemotherapy, using various drug treatments, injected into veins, muscles or the spine, to destroy cancer cells

If you consult with your Prostate Cancer Lawyer, or Prostate Cancer Attorney, you will be able to obtain difficult answers about your medical treatment that your hospital or doctor neglected to tell you.
