New York False Arrest Lawyer

In the 1973 movie Serpico, Al Pacino portrayed a real cop that fought injustices and corruption within the New York Police Department (NYPD). His portrayal of a cop plagued by police corruption was so accurate, he received an Oscar nomination for his performance. Thirty some years later, many of the same issues continue to pervade the NYPD. Malicious prosecutions and false arrests don’t just happen in the movies. They happen in real life all the time.

During a political convention, you expect to witness some heated debates and the clashing of ideas. You also expect conflicts to play out in the intellectual arena-but not on the streets, especially with the police force there to protect you. But that’s exactly what happened during the summer of 2004. Police maliciously prosecuted and falsely arrested numerous protestors at the Republican Convention in New York City. The New York Times reported that almost four hundred cases of arrests were dismissed after video recordings showed that there was no reason for the arrest in the first place. Some of the videos submitted by observers also exposed false police testimony.

What was one of the most alarming cases involving police misconduct during the Republican Convention? A man named Alexander Dunlop was arrested on Second Avenue and charged with resisting arrest. The police were going to submit a videotape as evidence against him. Dunlop said he was not even part of the protest, but was seized as part of a scare tactic by the police used to intimidate people. Luckily for Dunlop, his incident was captured on tape. The problem was, the police showed one version of the tape, but a volunteer found a more “complete” version of the tape that showed Dunlop had never resisted his arrest. The police’s version had been edited to remove the images proving Dunlop never resisted arrest. What was the police’s version of the story? They claimed that a technician must have accidentally cut out just the parts of the tape showing his innocence. Prosecutors didn’t believe their story and dropped all charges against Alexander Dunlop.

Malicious prosecution claims often accompany wrongful arrest and/or wrongful imprisonment claims, but they are considered separate claims. Malicious prosecution applies specifically to the criminal proceedings brought against you without probable cause. You can only sue for malicious prosecution after you have been acquitted of a crime. Simply being innocent is not enough-you have to prove that the prosecution did not have probable cause to arrest and prosecute you for the crime. This is where we come in. Our experienced team of police malicious prosecution and false arrest attorneys stay current with local laws and know how to deal with the unjustified claims brought by the police. We can help! Rely on us-we have over two decades of experience navigating the obstacles created by malicious prosecutions and false arrests.
