A new case of breast cancer will be diagnosed every 2 minutes and a woman will die every 13 minutes, according to an October 30, 2000 article in the Wall Street Journal. And it’s not just women that suffer from breast cancer. Reuters recently reported that the treatment of breast cancer in men is often delayed because doctors may not recognize the tumor and men may not suspect they have one. As a result, men typically seek medical attention far later than women. Men also have the same risks that Women do for Breast Cancer, but it’s a lot less publicized. The Physician Insurers Association of America states that the delayed diagnosis of malignant breast tumors is the single most frequent reason for medical malpractice lawsuits out of all the medical mistakes occurring annually in the United States health system. The study ultimately concluded that physicians must act more aggressively when women find lumps, bumps or cysts in their breasts. The most common reason for a delayed diagnosis in 55% of the cases studied, was that ''the physical findings at the examination failed to impress the physician,'' according to the report. The second most common reason in a delayed diagnosis was that mammogram reports were negative followed by the third reason-inconclusive findings.

The study also found that in 69 percent of the cases in which a claim was paid because a breast cancer diagnosis was delayed, the patient had discovered a lump on their own. Tragically, self-discovery cases are often ignored by physicians, especially in younger women because the chance for malignancy is considered less than with older women. Ironically, the study found that the majority of the lawsuits actually came from younger women. If your physician dismissed your discovery or was delayed in diagnosing your breast cancer for any reason, you have legal recourse. Let Michael Gunzburg, P.C. handle your claim. Doctors take an oath before they go into the practice of medicine and as a patient you hope that they have your best interest at heart. Yet because of the way the US healthcare system is structured, preventative care does not always equal profitable care. Insurance companies often reimburse doctors for mammograms at alarmingly low rates. Without a high monetary incentive for them, doctors and radiologists don’t always encourage mammograms. Many mammography centers have closed over the last decade as a direct result of the lack of money generated by them. With limited centers available to perform these tests, patients often have to wait months in order to schedule an appointment, which can delay their diagnosis of breast cancer and decrease their best chances for survival. Many times cancerous tumors are being detected at later, less treatable stages-putting the patient in grave danger. Radiologists are the most frequently sued defendants in breast cancer medical malpractice suits, with payouts averaging more than $200,000, according to the Physician Insurers Association of America.

There are some preventative measures that you can take to ward off breast cancer other than getting a regular mammogram. Evidence suggests that regular exercise helps reduce your body fat-in turn reducing your levels of cancer-promoting hormones like estrogen. The American Cancer Society also has recommend dietary guidelines that you can follow in order to prevent cancer:

  • Choose foods and portion sizes that promote a healthy weight.
  • Eat 5 or more servings of fruits and vegetables daily.
  • Choose whole grain versus refined grain foods.
  • Limit how often you eat processed and red meat.
  • Women should limit alcoholic beverages to 1 drink per day.
  • Women at high risk for breast cancer should consider not drinking alcohol at all.
